This casebook can be used as a companion volume to the HLT English Legal System Textbook, but also comprises an invaluable reference tool in itself. Its aim is to supplement and enhance students' understanding and interpretation of this particular area of the law, and to provide essential background reading. This book has been fully revised and updated for this latest edition. For ease of reference cases are arranged alphabetically within each chapter.
Of the thirty additions made in this edition, the great majority are cases reported during the last twelve months. Of these, four are decisions of the House of Lords and these are R v Gough (test of bias), Attorney-General v Associated Newspapers Ltd (secrets of jury room), Roebuck v Mungovin (dismissal for want of prosecution) and Racz v Home Office (discretion as to jury trial).
Topics considered in recent Court of Appeal decisions include the payment of costs by someone other than a party to the action (Symphony Group plc v Hodgson), the wrongful commencement of proceedings in the High Court (Restick v Crickmore) and, in relation to legal aid, the right to choose the cause of action (Joyce v Sengupta).
