Description
he growth of Equity as a 'second system of English law, which attempted to compliment the Common Law, saw the creation and burgeoning of what Maitland described as 'the greatest and most distinctive achievement performed by Englishmen in the field of jurisprudence... the development from century to century of the trust idea'.
These lecture notes provide a systematic, structured guide to a study of the essential features of equity and trusts. Equitable doctrines are outlined and explained; the key elements of trust law, with particular reference to the varieties of trust, the nature of trusteeship and the consequences of breach of trust, are analysed.
Many case references are given with the intention that students may be assisted in a methodical examination of some aspects of the rich literature of trust cases and commentary.
