Description

'Principles of Malaysian Land Law' seeks to set out the concise and comprehensive concepts and principles of Malaysian land law that can be easily understood by readers. It is useful for those interested to know more about the Torrens System as applicable in the Malaysian land administration system. Case law and statutory provisions are included in the chapters wherever necessary to provide references to facilitate the readers' understanding of a related issue. The authors explain the statutory provisions of the major areas of land law in an attempt to facilitate understanding and application of the various concepts and principles of the Torrens System in Malaysia. The book is intentionally designed to be simple and practical for students, and it complements other existing literature on Malaysian land law.

The book introduces readers to the brief history of Malaysian land law and general concepts of Malaysian land law to enable them to understand the reason for the introduction of the Torrens System in Malaysia. The book deals with the powers and rights of the State Authority as owners and administrators of all land within their respective states and the extent of their powers. The types of dealings recognised by the National Land Code 1965 and manner of creation of the dealings, registration and conferment of indefeasibility of title and interests upon registration is dealt with. The concept of restraining dealings as part of the Torrens System is dealt with in length due to its importance in the conveyancing practice in Malaysia.

Despite much emphasis on matters regulated by the National Land Code 1965 provisions. several chapters also touch on other related laws, like the Malay Reservation Enactment, Strata Titles Act 1985 and Land Acquisition Act 1960 which are very relevant and an integral part of the land administration system in Malaysia.
This book is the work of seven authors, all of whom are lecturers at Ahmad Ibrahim Kulliyyah of Laws as well as consultants with the Land Tenure and Environmental Management Unit (LATEM) a research cluster established specifically to conduct research on land tenure and environmental management law and policies.
