The aim of the book is to provide samples of the types of questions found both at first degree level and diploma courses. The questions are mainly in problem form with some essays.
The questions start with problems relating to the capacity to make a valid will, followed by formalities in the making and revocation of wills. The section on intestate succession includes the issues raised by the recent review of the law. Family provision is considered in detail. The types of legacy and their potential failure is followed by the general approach to the construction of wills. Finally, the book deals with the problems that can arise in the administration of the estate from the identity and powers of the personal representatives through to the winding up of the estate.
