Many of the chapters in this volume were first presented as working papers at one of the Feminism and Legal Theory Workshops I conduct at Columbia University Law School. During the course of this particular workshop, I was struck by the complexity and density reflected in the combined presentations of the legal issues surrounding violence against women and children. Some of the presenters seemed most involved in attempts to reconceptualize the whole topic of "domestic" violence- what, in the title to this volume, is labeled "private" violence.' Others were concerned with criticizing or developing specific legal solutions or proposing concrete policy responses. Still others explored topics often considered "taboo" in some more generalized feminist discussions, such as the appropriate legal response to the violence women perpetuate against children or against each other and the dilemmas for attorneys who defend them.

As it developed, the workshop had some distinctive aspects that enriched the nature and direction of the discussions. Most significantly, the papers, in addressing domestic violence as primarily a legal as well as a feminist issue, moved away from the psychological and emotional dimensions of the problem, and focused on the assessment of the direction and development of the law. This focus is important. The legal (or public) ramifications of the problem of domestic violence are often obscured in feminist discussions attuned to the plight of individual women and children living in the context of abusive situations. The papers at the workshop assumed law as a vital and central component in shaping as well as defining the nature of what constitutes domestic violence.
